The Americans with Disabilities Act (ADA) was established to prohibit discrimination against people with disabilities in several areas, including employment, transportation, public accommodations, communications, and access to state and local government programs and services. The ADA has set specific regulations for businesses, such as shopping centers, gas stations, etc. to accommodate those with disabilities so they may have equal access and opportunity as those without disabilities. For those without disabilities, it is simple to walk into a store, pick out what it is you want to buy, go up to the counter and pay without any inconvenience. Meanwhile, for those with disabilities, it is not so simple. The ADA protects those with disabilities and makes it so that their day-to-day activities are as simple as it would be for those without disabilities.
The ADA has three major concepts:
- A physical or mental impairment that substantially limits one or more of the major life activities of such individual.
- A record of such impairment.
- Being regarded as having such an impairment.
The definition of disability is at issue for all three of the points stated above. For example, for ones that have to use a wheelchair to accomplish everyday activities, a place that is doing business to all citizens has a guideline that has to be upheld to accommodate those who have to use a wheelchair or mobility aids. For those who are in need or use of mobility aids, such as wheelchairs, to enter a gas station, one would need a slope of specific angle and a wheelchair accessible door that would allow entrance. Not only is the entrance one of the many hardships if not maintained according to the ADA regulations.
Our firm has a passion to ensure that those who have to rely on mobility aids have equal access to every business according to the ADA regulations. Our firm targets those businesses who are actually doing business in the state of Mississippi and not upholding the regulations set forth by the ADA. For example, our firm filed a lawsuit against a business that did not maintain the regulations set forth by the ADA for those with disabilities. The result of that lawsuit was having every accommodation, including the slope entrance for the facility, the height of the check-out counter, the speed of the automatic door to the restrooms, and many other regulations, to be remedied and maintained.

Not only does our firm believe in making sure all repairs are made in accordance with the ADA regulations, but we make sure those facilities maintain those repairs to make sure that those with disabilities have equal access and opportunity to those facilities as anyone else would have.
